Terms of Service

1. Who We Are

These Terms of Service ("terms") are an agreement between you and MeloTools. MeloTools is a project run by Dushyant Patel, an individual (sole trader). In these terms, "we", "us" and "our" mean the operator of MeloTools.

2. Acceptance of Terms

By using MeloTools, including its tools and features ("Service"), you agree to these terms. You also confirm that:

• You are at least 13 years old to use the free tools
• You are at least 18 years old if you buy a Premium subscription
• You will use the Service in line with the laws that apply to you

If you do not agree to these terms, please do not use MeloTools.

3. Description of Service

The core MeloTools tools are free to use. We also offer an optional paid Premium plan (see section 7). MeloTools provides:

• Image format conversion (for example WebP, PNG, JPG and AVIF), processed on our server as described in section 11
• An image compressor that runs in your web browser
• Batch processing of several images at once
• Guides and informational content about images

Plan limits:

• Free: up to 5 images per conversion batch and up to 5MB per image
• Premium: up to 50 images per conversion batch and up to 75MB per image
• Image compressor: up to 10 images per batch on every plan, with no daily limit

4. User Licence and Restrictions

We give you a non-exclusive, non-transferable, revocable licence to use the Service for image conversion, compression and related purposes. You may use it for personal use, business use, agency work and any other lawful purpose. The core tools are free; Premium features require a paid subscription. Under this licence, you may not:

• Copy or reproduce the content, code or materials of the MeloTools website, other than the images you process
• Resell, sublicense or charge others for access to MeloTools or its features
• Reverse engineer, decompile or disassemble the Service, except where the law allows you to
• Remove or alter any copyright, trade mark or other notices
• Use the Service in breach of any applicable laws or regulations

5. Intellectual Property and Your Content

MeloTools Content: The text, graphics, logos, software and code that make up the MeloTools website belong to us or our licensors and are protected by intellectual property laws.

Your Content: You keep all rights in the images you process. When you use our tools:

• You give us a limited licence to handle each file solely to process your file and return the result to you, and for no other purpose
• You confirm that you have the right to process every image you submit
• You must not submit unlawful content

6. User Obligations and Prohibited Conduct

You agree not to use MeloTools:

• Illegal Purposes: For any unlawful activity or in breach of any law
• Intellectual Property Infringement: To process images that you do not have the right to use
• Malware: To upload or distribute malware, viruses or other harmful software
• Harmful Content: To process content that is abusive, harassing, defamatory, obscene or otherwise unlawful
• Unauthorised Access: To try to gain unauthorised access to MeloTools systems, networks or accounts
• Disruption: To interfere with, disrupt or overload MeloTools servers or services
• Impersonation: To impersonate any person or organisation
• Automated Access: To use bots, scrapers or automated tools to access the Service without our permission

7. Premium Subscription

Eligibility: You must be 18 or over to buy Premium.

Price and billing: Premium costs $20 (USD) per month, charged through PayPal at the start of each monthly period.

Automatic renewal: Your subscription renews automatically each month until you cancel.

How to cancel: You can cancel at any time from your Profile page with one click. Cancelling stops future payments. Premium stays active until the end of the period you have already paid for. We will email you to confirm the cancellation and the date your Premium access ends.

Refunds: Payments for a monthly period that has already started are not refundable, except where the law requires otherwise.

Your 14-day right to cancel (UK and EU consumers): You may cancel within 14 days of your first payment. If you asked for Premium to start immediately and acknowledged this at checkout, we may deduct a proportionate amount for the days you have used; otherwise we will refund you in full. To use this right, email support@mails.melotools.com.

Failed payments: If a renewal payment fails, Premium features are paused until the payment is completed. The free plan stays available to you.

Price changes: We will give you at least 30 days' notice by email before any price change applies to you. You can cancel before it takes effect.

8. Availability and Your Statutory Rights

We aim to keep MeloTools available and working well, but we cannot promise uninterrupted or error-free service. Please keep your own copies of your original images.

Nothing in these terms limits your statutory rights as a consumer. Under UK law, digital content and services must be of satisfactory quality, fit for purpose, as described, and provided with reasonable care and skill.

9. Limitation of Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law.

We are not responsible for losses that were not foreseeable when you started using MeloTools, or for business losses (such as lost profit or revenue) if you use MeloTools for business purposes.

Otherwise, our total liability to you is limited to the amount you paid us in the 12 months before the claim arose, or GBP 100 if that is greater.

10. Third-Party Services and Links

MeloTools may link to third-party websites and services that we do not control. Premium payments are handled by PayPal. We are not responsible for:

• The content, accuracy or practices of third-party websites
• Privacy practices of third-party services

Your use of third-party services is governed by their own terms. We encourage you to review their policies before use.

11. Data and File Handling

Image compressor: The image compressor runs in your web browser. Your images are not uploaded to our servers when you use it.

Format converters: The format converters send each file over an encrypted (HTTPS) connection to our server, convert it, return the result to you and delete both the original and the converted copy from our server immediately afterwards, including when a conversion fails. Files over 4.4MB are converted in your browser instead, on every plan, so they are not uploaded.

Conversion records: When a conversion completes we record the file type, file size, output format, time and, if you are logged in, your account ID. We do not record file names. We keep these records for 90 days and use them to run the service, apply plan limits and prevent abuse.

Please keep backups of your original files. Our Privacy Policy explains how we handle personal data.

12. Termination and Suspension

We may:

• Suspend or end your access to MeloTools if you seriously or repeatedly break these terms
• Suspend the Service temporarily for security, legal or maintenance reasons
• Close your account and delete associated data if you break these terms

If we end your Premium subscription for a reason other than your breach of these terms, we will refund the unused part of any period you have paid for. You can stop using MeloTools and cancel Premium at any time.

13. Changes to These Terms

We may update these terms from time to time. The date at the top of this page shows the latest version.

For material changes we will email Premium subscribers at least 30 days before the change applies, and you can cancel before it takes effect.

14. Business Users

If you use MeloTools for business purposes, you agree to compensate us for reasonable losses and costs (including legal fees) arising from:

• Your breach of these terms
• Images you process that infringe the rights of others

15. Governing Law and Your Rights

If you are a consumer, nothing in these terms removes the protection of the mandatory laws of the country where you live, and you can bring proceedings in your local courts.

16. Complaints and Disputes

If you have a problem with MeloTools, please contact us first so we can try to put it right:

• Email support@mails.melotools.com with details of your complaint
• We will try to resolve it with you in good faith within 30 days

This does not affect your right to bring a claim in the courts or to use any other route the law gives you.

17. Severability

If a court finds any part of these terms invalid or unenforceable, the rest of the terms will continue to apply.

18. Entire Agreement

These terms are the whole agreement between you and MeloTools about your use of the Service. Our Privacy Policy explains how we handle personal data.

19. Waiver

If we do not enforce any part of these terms straight away, we can still enforce it later.
